So here is the message please help me discern if this legit or fake and also how to deal with this situation.
Dear Mr. Rayaan,
I am contacting you to inform that you have been communicating with a representative of Microsoft’s Digital Crimes Unit (DCU) and not to a buyer.
The DCU is a global legal team which fights software piracy, counterfeiting and cybercrime to protect computer users and Microsoft customers. I am under authority from its Indian Division to monitor online software piracy activities in India and to warn those who participate in these unlawful activities.
We last contacted you on 23 September 2019 regarding your listing of Office 365: we have been regularly monitoring your online offer of Microsoft software on OLX and based on the information provided, you are at risk of selling unlicensed Microsoft product(s), which may constitute an infringement of Microsoft’s copyright and trademark rights. Please be aware that loose COA’s/PK labels and loose keys are not in themselves licenses and as such cannot be resold as being (or granting rights to access) legitimate Microsoft software.
Please note that Microsoft takes any infringement of their intellectual property rights very seriously. Indeed, Microsoft seeks to protect its customers from buying counterfeit/unlicensed software and seeks to ensure that genuine resellers are not put at a disadvantage because of such illegitimate offerings. Selling counterfeit/unlicensed Microsoft products is unlawful and if it is proven to be the case here, it will be no defence to say that you believed the sales were legitimate. If you are unsure as to what is legitimate or illegitimate, then I recommend that you seek independent legal advice to ensure you are not infringing Microsoft’s intellectual property rights.
Although not the case at this stage, I furthermore want to emphasize that in principle Microsoft will undertake legal actions against sellers whose offerings have been proven to be counterfeit/unlicensed and therefore Microsoft’s DCU will be informed of all our engagements. In that respect, please note that we will be monitoring your online activities closely to observe your compliance and will track any attempt you make to change IDs and post new ads on other online platforms. If you ignore this warning, you may face legal action.
I hope that you will take note of and act upon this message. If you wish, DCU’s local representative will send you a formal email confirming this message to the email address you provide me with.
Microsoft reserves all rights (for instance to make claims) in relation to your activities.
